But this morning I had reason to leap out of bed at the ungodly hour of 05:30 to hit the computer and report on some very good news.

Our government has gone done something good and given that this doesn’t happen very often, I reckon it’s worthy of a pre-dawn blog post.

The news, which was brought to my attention by Fuzztwin on Twitter, reports on changes to the current childhood immunisation schedule to include three new vaccines and increase the incentives for parents who complete the schedule, effective 2013.

Chickenpox or varicella which as not previously been covered by the schedule (and hence was an out-of-pocket expense for parents wanting to vaccinate against chickenpox) will now be included.

Also new is vaccinations for meningococcal C and pneumococcal.

The new schedule brings the number of infectious diseases covered by the schedule to twelve.

Importantly, reports indicate that the number of shots kids will be required to get will actually be reduced however, since there will be new combination vaccines used.

According to a report in The Herald Sun a new combination vaccine will cover measles, mumps, rubella and chickenpox in one shot and will be administered at 18 months replacing the previous MMR given at 4 years. The number of visits will increase however, owing to the new scheduled shot at 18 months.

There are also changes to the incentive scheme for parents and this is where it gets interesting (well, for nerds of legislation like me).

Under the current maternity immunisation allowance scheme introduced in 1997, parents receive two one-off payments totalling $258 if they complete the vaccination schedule. This will be scrapped under the new system and replaced with three payments of $726 each, paid at one, three and five years. If kids are not fully vaccinated, then the $2100 will be withheld. (This is part of the current family tax benefit part A end-of-year supplement so it’s not an entirely new benefit).

Health Minister Nicola Roxon said: “We know that immunisation is fundamental to a child’s lifelong health and that’s why we want to make sure that children are immunised at the right time.

“We want all Australian kids to grow up healthy, and immunisation is essential to that.”

What is not mentioned in any of the news stories is whether this effects the current options for conscientious objectors. Under the current system, you can still get the maternity immunisation allowance even if you don’t vaccinate, if you identify as a conscientious objector (CO). Excerpt from the Centrelink website which administers the payment:

a recognised immunisation provider (e.g. your doctor) signs a letter or form saying that:

• they have told you about the benefits and risks of immunising your child and you have a conscientious objection to immunising your child (your provider should complete a Health Insurance Commission Immu-12 form),

• immunising your child with a particular vaccine is medically contraindicated (your provider should use the Health Insurance Commission Immu-11 form),

• the child has a natural immunity to the disease, or

• the vaccine is not available,

• you or your partner are a member of the Church of Christ, Scientist and you have a letter from an official of the Church advising that you are a practising member of the Church.

This is certainly going to be the bit the anti-vaxers are interested in. The news stories appeared overnight (at least one was published at 12:00) so we have yet to see a reaction from Meryl and her buddies. But you can expect some major *head asplosions* on this one, guaranteed. Particularly since Meryl had previously claimed she has some sort of influence when it comes to vaccination policy. It seems she might have missed this one.

This is not the only piece of good news in this story either. Reports also detail a new pertussis awareness campaign in the form of mail-outs to warn parents about the dangers of the current epidemic and advise on ways to protect their kids.

This is a direct response to campaigning by the McCaffery family who lost their baby Dana in 2009 at 4 weeks of age in the grips of a pertussis epidemic. The family was never warned about the risks of pertussis or that they needed, as parents and carers, to get boosters, since the effectiveness of the vaccines wanes over time.

From the Age:

Ms Roxon said the aim of the whooping cough campaign was to raise awareness, particularly among parents planning pregnancies and others to be aware of the dangers to infants and the need to have vaccinations at two months, four months and six months after birth.

But the vaccinations do not provide lifelong protection from whooping cough and children should have booster shots at age four and then during teenage years, Ms Roxon said.

”Whooping cough is not just a childhood disease, as adolescents and adults can account for half the cases in the community.”

Overall, this is a step in the right direction by the Australian Government and I applaud Nicola Roxon for (finally) taking action. The introduction of the chickenpox vaccine is also a welcome addition to the schedule, since it costs as much to get as the current maternity immunisation allowance (~$200) making the incentive seem moot.

It’s still early in Australia, and since this story only broke overnight, I wait with interest for the response of the anti-vaxers. I’ve also searched, but to no avail, for a government media release, as I’m keen to find out if any changes have been made to the CO conditions.

One suspects they will remain in place, at least in some form, since they are necessary for kids with genuine medical reasons for not vaccinating, but given that the maternity immunisation allowance scheme is to be scrapped, it appears they will at least need to be migrated, if not re-drafted.

I await with interest.

There were some big “wins” for critical thinking in 2010, but sadly alternative medicine and scams continued to abound, with the explosion in popularity of Power Balance bracelets a very good example of the continuing gullibility of the general public. On the plus side, the anti-vaccination movement continued to take hits, with Andrew Wakefield being struck off the UK medical register and the AVN losing their charity license and being called a threat to public health and safety by the HCCC.

And of course the year ended with a bang, with Australia’s largest sceptical convention ever to come to Australia, TAMOz, held in Sydney in November.

Below are just a few of the events I feel contributed to a very exciting and positive year in scepticism, plus some of the not so positive, as a reminder of why we need keep pushing the message of critical thinking. This is by no means an exhaustive list, and if you have one you think I have missed feel free to leave it in the comments.

January 30th: Ten23 – worldwide homeopathy overdose.

The brainchild of the Merseyside Skeptics Society, Ten23 was designed to inform the public that “homeopathy: there’s nothing in it”. It was a huge success, attracting extensive media coverage across the UK. The event was mirrored in Perth, Sydney and also very successfully in New Zealand where Christchurch’s Vicki Hyde received significant media attention for her role in organising events across the pond. Events for 2011 are already being organised and the campaign looks to be even bigger this time around.

The Ten23 protest in the UK was designed to demonstrate that there's nothing in homeopathy.

At the Ten23 protest in Sydney, some participants fell asleep almost 12 hrs after "overdosing" but woke up 8 hrs later.

In the UK the pharmacy Boots came under fire for admitting they sell homeopathic products, not because they work but because people want them.

February 22nd: UK Committee on Science and Technology Evidence Check says homeopathy doesn’t work.

Following the investigation, committee chairman Phil Willis MP said; “We were seeking to determine whether the Government’s policies on homeopathy are evidence based on current evidence. They are not.”

The report recommended that the National Health Service (the public purse in the UK) no longer fund homeopathy. The report also;

• Recommend no further clinical trials of homeopathy.
• Found evidence for homeopathy working was lacking.
• Explanations for why homeopathy works are “scientifically implausible.”
• Committee viewed homeopathy as placebo.

Despite these recommendations, on July 26th it was announced that homeopathy was to remain on the NHS.

March 10th: Libel case against Paul Offit and Amy Wallace dismissed.

Two days before Christmas in 2009, Barbara Loe Fisher from the US-based anti-vaccination group National Vaccine Information Council (NVIC), filed a $1 million claim that Dr. Paul Offit had libeled her in Wallace’s “Wired” article “An epidemic of Fear, One Man’s Battle Against the Anti-Vaccine Movement“.

The offending paragraph is reproduced below.

“Offit is quick-witted, funny, and — despite a generally mild-mannered mien — sometimes so assertive as to seem brash. “Scientists, bound only by reason, are society’s true anarchists,” he has written — and he clearly sees himself as one. “Kaflooey theories” make him crazy, especially if they catch on. Fisher, who has long been the media’s go-to interview for what some in the autism arena call “parents rights,” makes him particularly nuts, as in “You just want to scream.” The reason? “She lies,” he says flatly.”

Loe Fisher took exception to the statement “she lies”, and named her price of USD1million. Condé Nast, the publisher of Wired Magazine, was also named in the suit. Bloggers reflected on the propensity of the anti-medicine crowd to resort to legal action when they are unable to defend their positions with evidence. The suit was dismissed before it could be heard, and the court’s decision is detailed below:

“In this case, the article’s quotation of Defendant Offit’s comment that Plaintiff “lies” cannot reasonably be understood to suggest, as the Complaint alleges, that Plaintiff is “a person lacking honesty and integrity . . . [who should be] shunned or excluded by those who seek information and opinion upon which to rely.” Rather, the context of the remark – in a lengthy article describing an emotional and highly charged debate about an important public issue over which Defendant Offit and Plaintiff have diametrically opposed views – plainly signals to readers that plainly signals to readers that they should expect emphatic language on both sides and should accordingly understand that the magazine is merely reporting Defendant Offit’s personal opinion of Ms. Arthur’s [Barbara Loe Fisher’s] views.”

This is not the first time this has happened and likely won’t be the last. However, with the rise of the grass roots skeptical movement, it is becoming harder for anti-vaxers and others without evidence on their side, to hide behind “legal chill”.

March 12th: US Vaccine Court rules thiomerosal does not cause autism.

The claim that autism is linked to vaccinations, and in particular the measles-mumps-rubella (MMR) vaccine, took a further blow in March with the US Court of Federal Claims rejecting claims in three separate cases that the mercury-containing preservative, thimerosal, causes autism. Three cases selected from a pending class action of thousands, ruled on by three judges called ‘special masters’, were chosen as test cases as they were considered to be among the strongest proposed.

Special Master George L Hastings wrote in his judgement on one case that “This case … is not a close case. The overall weight of the evidence is overwhelmingly contrary to the petitioners’ causation theories.”

Patricia Campbell-Smith, special master on another case, said that “The petitioners’ theory of vaccine-related causation is scientifically unsupportable.” Sadly this has not changed some parents perception that vaccines cause autism.

April 15th: The BCA drops its case against Simon Singh


The BCA brought a claim for libel against Simon Singh after an article he wrote describing the BCA as happily promoting bogus treatments. Justice Eady agreed with the BCA’s interpretation, that Singh had made a serious allegation of dishonesty. However, the Court of Appeal ruled Singh’s comments were expression of an “honest opinion”.
On April 15th, the BCA withdrew the case. In a statement they wrote: “The BCA takes seriously its duty and responsibilities to members and to chiropractic patients. The BCA have considered taking leave to take this matter to the Supreme Court and has been advised that there are strong grounds for appeal against the court of judgement appeal. However, while it was right to bring the claim at the outset, the BCA now feels that the time is right for the matter to draw to a close.” You can read a summary of events here.

Even though Singh effectively “won” the case, it still cost him thousands of pounds of his own money (and he will never recoup it all). Importantly, his case prompted changes to the UK libel laws which are currently ongoing.

April 23rd: FluVax® Junior suspended for under 5s after increased adverse reactions.


The seasonal flu vaccine was suspended for kids under five years of age after 55 children suffered convulsions following the vaccination, and almost 200 others suffered fevers and vomiting.

A task force convened by the CDC and headed by Nobel laureate Professor Peter Doherty did not find a conclusive cause for the convulsions but the “current working hypothesis” was that the strain of swine flu used in this year’s seasonal flu vaccine appeared to contain a higher than usual level of a protein called neuraminidase.

The problems were confined to CSL’s FluVax® Junior preparation and its use in under fives remains suspended. However two other brands of flu vaccine for children are safe and continue to be administered. An autopsy following the sudden death of a two-year-old Brisbane girl 12 hours after she received the flu jab, could not be linked to the vaccine.

May 24th: Andrew Wakefield struck off the UK medical register.


The Wakefield investigation was the longest in the history of the GMC, with the disciplinary panel sitting for a total of 148 days over a period of 2 and a half years at an estimated cost of one million pounds. The results of the investigation were revealed in a 143 page report on 28th January 2010, and found that Wakefield showed a “callous disregard” for childrens’ suffering and “abused his position of trust.”

Timeline: February 1998: The Lancet study published, suggesting MMR vaccine might be linked to a higher risk of bowel disorders. Wakefield suggests at a press conference that MMR may overload a child’s immune system, thus planting the seeds for MMR = autism.

January 2001: Dr Wakefield claims that the combined MMR vaccine has not undergone proper safety tests. Ostracised by the British medical community, Dr Wakefield and his family move to Texas.
February 2004: The Lancet announces a partial retraction of the 1998 paper, on grounds of “a fatal conflict of interest” — The Sunday Times has reported that Dr Wakefield received £55,000 from the Legal Aid Board for research to support legal action by parents who claimed that their children had been harmed by MMR. The UK GMC announces an investigation.
March 2005: Japanese scientists say they have evidence that the MMR vaccination is not linked to a rise in autism: cases increased after withdrawal of the MMR jab. Studies in Britain and elsewhere support this.
July 2007: The GMC hearing against Dr Wakefield and two of his colleagues begins. It is expected to last four months.
February 2010: The Lancet retracts the 1998 paper. Neurotoxicology retracts an article in press from Wakefield. He resigns from Thoughtful House.
May 2010: After the longest investigation in the history of the GMC, Wakefield is struck of after being found guilty of “multiple separate instances of serious professional misconduct”. He is found to have “abused his position of trust” and brought the medical profession into disrepute. “Callous Disregard” (with forward by Jenny McCarthy) published.

The last medline indexed peer reviewed paper you will find from Wakefield was published in 2006. A search for “Wakefield AJ” on PubMed brings up 112 hits. Wakefield was a prolific, extensively published and competent researcher. Sadly, he now tweets links to anti-vaccine groups and publishes in the woo/conspiracy fest journal, Medical Hypotheses. He will likely never publish in mainstream science journals again.

July 12th: HCCC report calling the AVN “misleading” released.



After a 12 month investigation the Health Care Complaints Commission (HCCC) finally handed down their findings into the Australian Vaccination Network (AVN).

The commission concluded; the AVN provide misleading information about vaccination and must post disclaimers on their website clearly stating they are anti-vaccination.

The report found evidence that the AVN misleads readers by using reliable and peer reviewed literature but selectively quotes from it, often in contradiction to the conclusions or findings of the studies. The AVN also gives non-peer reviewed and anecdotal material the same authority as peer-reviewed literature. The findings were covered in an exclusive story by Steve Cannane on Lateline, where he famously caught Meryl Dorey out denying she had written something; “Did I say that? I don’t believe I did..”.

July 26th: Public Warning about the AVN released.

Following the refusal
by the AVN to place a disclaimer on their website, the HCCC issued a public warning about their misleading information.

This resulted in a surge in interest by the media and the Streisand Effect taking hold.  The AVN were in the spotlight, but for all the wrong reasons. For the first time, we began to see them referred to as “anti-vaccine” by the mainstream media. Their arrogance in refusing to put the HCCC disclaimer on their website had well and truly backfired.

July 31st: Coroner finds cancer death due to “misinformation”.


Penelope Dingle died in 2005 from untreated bowel cancer aged 45, after being diagnosed in 2003. She first presented with bleeding from the bowel in 2001. Following a colonoscopy, she was advised by doctors to have surgery to remove the cancer. She declined conventional cancer treatment, instead deciding on following a regimen of alternative treatments including special diets, vitamins and homeopathy.

State Coroner Alastair Hope found that homeopath Francine Scrayen convinced the ailing woman she could cure her cancer. By the time Mrs Dingle agreed to emergency surgery for a complete bowel obstruction, she was in severe pain and her bowel was almost at the point of splitting open. She would have died within 24 hours if she had not had the emergency surgery.

According to evidence given at the inquest from friends of Mrs Dingle and from her diaries, she and her husband, Dr Dingle made a pact with homeopath Francine Scrayen to not take any conventional treatment including pain relief. Dr Dingle also planned to write a book about how to cure cancer with homeopathy and alternative treatments once his wife was cured. Another case for What’s the Harm in homeopathy?

August 2nd: The Australian Medical Association issues a warning about the AVN.



September 1st: The AVN in trouble for copyright breaches


An article from the Sydney Morning Herald describes:

“an anti-vaccination group is under fire for allegedly breaching copyright laws by selling newspaper and medical journal articles online without permission from the authors.

The packs, which were selling for up to $128, included home-made books filled with articles photocopied from journals around the world, information on drugs taken from MIMS, the medical guide used by doctors and nurses, and copies of brochures inserted in medication boxes by pharmaceutical companies.

Under the Copyright Act, articles can be copied for personal research or for use by students but cannot be disseminated widely or sold.”

In response, Meryl said she was “unaware she had breached copyright”. This is despite the fact that she is listed as the editor of her own publication Living Wisdom which has this permission to reproduce policy inside the magazine: “Whilst reproduction and dissemination of the information found in Living Wisdom is actively encouraged (unless otherwise stated), it is expressly forbidden for anyone to reproduce any of this information for the purpose of profit…”. Hypocrites much?

September 3-6th: “Hug me! I’m vaccinated” free vaccine clinic at Dragon*Con.


The brain child of Skepchick’s Elyse Anders, the clinic was set up in an empty shop front for the Labour Day weekend and offered free pertussis boosters and HIV testing to coincide with the world’s largest Sci-Fi convention in Atlanta, Georgia. In the midst of an epidemic of pertussis, in which 10 babies have already died in California, the clinic exhausted their supplies of vaccine by the end of the weekend.

Elyse wasn’t able to attend Dragon*Con since her baby had not yet received all of his shots for pertussis thus making the risk of him attending too great.

Elyse has recently been the subject of an Age of Autism smear campaign for her work in getting a SafeMinds ad pulled from cinemas during the US Thanksgiving Weekend. You can read about it here. The power of Twitter, the popularity of which has exploded in 2010, was effectively harnessed to mobilise the masses and get these ads stopped.

October 20th: The AVN loses their charity license.


Following a complaint submitted by Wendy Wilkinson, the OLGR audited the AVN and found breaches sufficient for the revocation of their charity license. These include a number of breaches of charity laws, including fundraising without an authority, unauthorised expenditure and failure to keep proper records of income and expenditure.
The revocation means the AVN is only able to solicit funds from current members not from members of the public, which has been a big blow for them financially. An appeal scheduled to be heard on December 10th was postponed.

The OLGR said it had also identified possible breaches of the Charitable Trust Act which will be referred to the NSW Department of Justice and the Attorney General. There are substantial penalties for these offences, including fines of up to $5,500 per offence or jail time. These investigations are ongoing. Ms Dorey continues to plead her innocence.

October 26th: Choice Magazine awards Power Balance a Shonky.


Power Balance, the $60 piece of rubber claimed to improve your strength and balance, was declared a bare faced con at the annual Choice Shonky Awards held in Sydney. The Choice website says; “with some reluctance, we highlight the inherent shonkiness of the Power Balance bracelet – reluctance, because when Australian Skeptics demonstrated on Today Tonight that it patently didn’t do anything, subsequent sales skyrocketed: apparently any publicity is good publicity after all. We CHOICE sceptics did our own testing under controlled laboratory conditions – after all, you can’t believe everything you see on TV – and verified the Skeptics’ findings. So, if a fool and his money are soon parted, there are apparently plenty of fools out there – and they’re all conveniently identified with a rubber band bracelet.”

November 28th: TAM Australia declared a stupendous success!

With over 620 delegates, 51 speakers, 2 and a half days of talks, panels and workshops the very first TAM Australia was declared a huge success by all involved. Speakers included Dr Rob Morrison, Dr Pamela Gay, Julian Morrow, Steve Cannane, SGU, Brian Dunning, Steve Novella, Simon Taylor, Eugenie Scott, George Hrab and many many more! This was the first TAM ever to be held in Australia but it certainly won’t be the last.

Odd that this should happen really, since I often get accused of not reading what the anti-vaxers have to say. This couldn’t be further from the truth. In additional to the tripe on the Facebook pages, the forums, the mailing lists and comments on news articles, I have perused the information pack for conscientious objectors, flicked through Living Wisdom and looky over there >>> a copy of Callous Disregard by Andrew Wakefield.

It’s more than I suspect they do with respect to research. Although, Meryl Dorey says she reads papers about vaccination but apparently comes away with completely different conclusions to the authors, making the exercise rather futile.

Indeed, the recent HCCC investigation concluded that whilst the AVN may cite peer-reviewed research, they quote selectively from it, often in contradiction to the conclusions or findings of the studies themselves.

Ms Dorey explained this discrepancy with the following:

“It is true that oftentimes, our information will contradict the conclusions or summaries of the studies. This is because, as opposed to most doctors and government officials, we actually read the studies and frequently, the summary and conclusion does not agree with the raw data itself…..Many times, that disconnect can be explained by the financial links between the study’s researchers and the companies whose products are being studied. So, whilst the AVN does frequently draw different conclusions to those printed at the end of these articles, it is because our analysis of the data shows that the printed conclusions do not correspond with the raw data. This is not selective reporting – it is accurate reporting.”

Raw data. It doesn’t mean what you think it means Ms Dorey. And the financial links? Oh course, the old shill canard again. When you ‘aint got nothin’ else.. (and you don’t know how to read papers).

The AVN have been in oodles of trouble lately, the most recent being for multiple breaches of copyright associated with selling material on their website without permission. Which is funny, because one of the things I came across in the information in Living Wisdom was their permission to reproduce policy:

“Whilst reproduction and dissemination of the information found in Living Wisdom is actively encouraged (unless otherwise stated), it is expressly forbidden for anyone to reproduce any of this information for the purpose of profit…”

My emphasis.

Which directly contradicts the reason they were recently in strife – for selling other authors’ material on their website, without permission.

An article from the Sydney Morning Herald describes:

In response, Meryl said she was “unaware she had breached copyright”. This is despite the fact that she is listed as the editor of Living Wisdom and therefore probably wrote the policy. Even if she didn’t, one would think it is part of her job to understand copyright restrictions as the editor of a magazine for more than a decade.

But the duplicity of the AVN is something we have come to know well. This is a recent screen capture from their website.

So it appears Meryl knew about some of these copyright rules “a couple of years ago” at least.

One wonders if the authors contacted by the Sydney Morning Herald decided to take any action against the AVN given some might be owed a nice wad of booty. Based on the AVN’s permission to reproduce policy, they themselves would be joining a queue to recoup any lost funds. So what’s good for the goose is good for the gander right?

Oh wait, except when you’re a bunch of hypocrites.

The AVN was targeted in the statement in which AMA Vice President, Dr Steve Hambleton said that recent media reports outlining the views of the AVN show that this organisation has drawn the fire of the NSW Health Care Complaints Commission (HCCC).

“While we all value freedom of speech in our society, groups that promote what the NSW HCCC has described as misleading, inaccurate and deceptive information about immunisation, under the guise of ‘pro-information’ and ‘pro-choice’, are putting Australians at risk of diseases that can be prevented through vaccination” he said.

The AVN have previously been in legal strife with the AMA. Back in 2007 they published an advertisement on mandatory vaccination of healthcare workers in NSW which made some rather spurious claims about the AMA. The ad had been submitted to NSW Doctor magazine but was rejected upon the committee checking the AVN website and “finding out that we only had one medical practitioner listed amongst our Professional Members”.

So the AVN published it on their website, until the AMA’s lawyers got a gander at it. The AVN was forced to remove the ad and publish a retraction in its place which said (in part):

In particular it has been brought to the attention of the Australian Vaccination Network, the the Australian Vaccination Network accepts, that:

1- AMA (NSW) does not obtain any of its funding from pharmaceutical companies;

2- AMA (NSW) has not published any advertisement or advertorial for a pharmaceutical company in the NSW Doctor for a period of at least four years, and at no time has the advertising in NSW Doctor been almost exclusively that of pharmaceutical companies;

3- AMA (NSW) does not actively censor information made available to its members.

The Australian Vaccination Network unreservedly apologises for any offence or embarassment the publication may have caused AMA (NSW), its officers and employees.

Ads being rejected sight unseen by publishers is something the AVN are also familiar with. Remember when Sydney’s Child also rejected an ad from them back in April?

Misleading claims about vaccination putting Australian lives at risk

Vice President, Dr Steve Hambleton, said today that the AMA is greatly concerned that groups that are promoting discredited theories about immunisation are exposing Australians to the devastating effects of preventable illnesses.

Dr Hambleton said that recent media reports outlining the views of the Australian Vaccination Network (AVN) show that this organisation has drawn the fire of the NSW Health Care Complaints Commission (HCCC).

“It is important for parents to have their children immunised. Immunisation saves lives,” Dr Hambleton said.

“While we all value freedom of speech in our society, groups that promote what the NSW HCCC has described as misleading, inaccurate and deceptive information about immunisation, under the guise of ‘pro-information’ and ‘pro-choice’, are putting Australians at risk of diseases that can be prevented through vaccination.

“We are now almost two generations away from deadly diseases such as tetanus, diphtheria and polio. Our grandparents will still remember how bad it was.

“Parents who choose not to immunise their children need to consider that they are putting not only their own children at risk, but they are also risking other children, with potentially fatal consequences.

“If immunisation rates fell because many parents relied on the efforts of other families to vaccinate their children, under the misapprehension that this would provide sufficient protection to the whole community, there would be new epidemics of old illnesses.

“The last outbreak of measles occurred in a school in an area with low immunisation rates. The outbreak was so severe that it interrupted the educational curriculum.

“The NSW HCCC’s findings and concerns regarding the AVN released last month are consistent with the views of the medical profession.

“It is critical that Governments promote the evidence and benefits of full immunisation and run an ongoing public education program that informs the public about the devastating effects of diseases that can be avoided through vaccination.

“The AMA welcomes the announcement last week that seasonal flu vaccination of young children can now be resumed, and commends the Commonwealth Chief Medical Officer for taking early action to investigate this matter and the latest advice, which means we can maintain confidence in our vaccination program,” Dr Hambleton said.

One wonders if Meryl Dorey would have saved herself a lot of bad publicity had she just quietly posted the disclaimer as requested. As it turns out, there have now been two waves of bad publicity for the AVN. The first, after the HCCC report was released some two weeks ago and now the second wave with the refusal to post the disclaimer.

It seems the tide has definitely turned in the media with respect to the AVN. Previously the majority of the reporting was staunchly about “balance” never referring to the AVN as anti-vax and generally giving Meryl a pretty easy ride when it came to her avoiding the question of “you say you’re not anti-vax but which vaccines do you recommend?”.

And if you don’t believe me, listen to Steve Liebermann – who reckons the AVN should be shut down – tear shreds off the AVN on radio 2UE.

In the extensive coverage of the last few weeks, there has only been one example of television that I have seen the term “balanced” used and that was on the frothy morning show Sunrise (not known for hard hitting journalism). This morning the show interviewed both Meryl Dorey and Prof. Booy, who had both previously appeared on Radio ABC 702 Sydney. Even when Meryl got a pretty easy ride from the interviewer, there was no misunderstanding about the agenda of the AVN, as Prof Booy made it abundantly clear by referring to the AVN at least twice as the Anti-Vaccination Network.

And whilst there was a follow up story in today’s SMH, (following yesterdays front page criticism), interviewing Dorey and detailing her reasons for starting on her anti-vax crusade, it was juxtaposed with a series of rather loopy quotes from Dorey. In a column entitled “Dorey on vaccines” four quotations were published. Although they’re certainly not the most loopy I have seen from Meryl, they nonetheless do not make her look particularly “balanced” and “pro-information” (as she is still feebly clinging to BTW).

“I don’t see that the measles vaccine has done anything for Australia”

“Make no mistakes folks, this measles “outbreak” has been orchestrated for one reason and one reason only – to force the issue of compulsory vaccination.”

More conspiracy nonsense from Meryl, directly contradicting one of my favourite quotes from her;

“…we are already seen as rabid, idiotic fringe dwellers by so many in the mainstream, it does our cause no good at all to bring in conspiracy theories, which though we may subscribe to them, are unprovable.”

Thanks to the hard work of Steve Cannane who kicked this campaign off with the awesome report on Lateline some 2 weeks ago, the tone has been set in the media. Steve did a follow up story last night, this time covering the government’s seemingly disinterest in instigating the vaccination education campaign they have been promising for what seems like an eternity.

In the meantime the McCafferys (who have been extremely brave and stoic throughout this entire nightmare) have contributed to a website in collaboration with Professor Booy called Chain of Protection

Meanwhile Meryl continues unabated. She continues to bleat they are not anti-vax, that the HCCC does not have jurisdiction over them, that she is seeking legal advice etc etc. It’s like a broken record.

Pro-tip Meryl, saying it over and over again will not make it right. And because you arrogantly refused to put up the disclaimer, many more people now know just that.

The public statement was issued after a fortnight’s grace during which time the AVN were instructed to issue a disclaimer on their website stating that;

• • The AVN’s purpose is to provide information against vaccination, in order to balance what it believes is the substantial amount of pro-vaccination information available elsewhere.
• • The information provided by the AVN should not be read as medical advice.

The public warning follows a 12 month investigation into the AVN after 2 complaints were received.

The Commission’s investigation of the complaints focussed on the material presented by the AVN on its website www.avn.org.au. The Commission established that the AVN website:

• • provides information that is solely anti-vaccination
• • contains information that is incorrect and misleading
• • quotes selectively from research to suggest that vaccination may be dangerous.

The AVN was given 2 weeks to post the disclaimer in a prominent position on their website. When the deadline passed, the HCCC was forced to issue the public statement.

Meryl Dorey, media spokesperson and immediate past president of the AVN responded by repeating she does not believe the HCCC has jurisdiction over the AVN and she is seeking legal advice in this regard. (She has been “seeking legal advice” about this matter for what seems like the duration of the investigation).

In a blog post entitled “AVN vigorously opposses HCCC notice” Meryl (who refers to the AVN as a “consumer advocacy and vaccine safety watchdog group”), states:

“Three times since this investigation started last September, the AVN has provided the HCCC with information on their lack of jurisdiction. Each time, this information has been ignored.”

“The HCCC states that our information is misleading because we do not include data on the benefits of vaccination,…..nobody would expect……those who argue against fluoridation of the water supply to write reports about the benefits of mass medication without individual consent.”

So apparently fluoride in drinking water is “mass medication” now?

But it gets even more hilarious.

“The AVN is currently in discussions with our legal advisors….. to defend against the unsubstantiated allegations that our information is anything but complete, unbiased and fully-referenced from the medical literature.” (emphasis mine).

Unbiased and fully-referenced? Meryl, surely you jest. Even you have admitted you don’t tell both sides of the story. And as for fully referenced? Well the HCCC had something to say about that too.

Fully referenced also might not mean what you think it means Meryl. For example, copying and pasting incorrectly attributed references from whale.to is not considered “fully referenced”.

Meanwhile Meryl is still screeching “free speech” and “democracy”. A comment left on her blog offered a much more sinister reason for the HCCC “witch hunt”.

Not only do the Australian public now know the true nature of the AVN‘s agenda, Meryl appears to have got herself in some hot water over scanning and posting a pro-vaccine magazine article on her blog. The article, published in Cosmos Magazine, got her ire when she was apparently misquoted after declining to be interviewed. The publishers are now seeking legal advice about the breach of copyright and will be taking action to have the article removed.

And in another schemozzle, Meryl appears to have passed on the email list from her subscriber base to a third party, which breaches email privacy laws in Australia. Although in a blog post published today she denies this is the case.

This came about with the distribution of a media release from the International Medical Council on Vaccination, announcing their support for the AVN and “condemning the attempts of an Australian Government body to censor and suppress their work.” It was signed by well known anti-vaxers Sherri Tenpenny, VacTruth, Moms Against Mercury, and even Judy Wilyman, amongst others.

AVN readers have already begun to write to the HCCC complaining about the findings. One suggested:

• “The HCCC’s purpose is to provide misleading information about the importance and efficacy of vaccination, in order to perpetuate the substantial amount of one-sided, pro-vaccination information available everywhere.”

Or perhaps the science tells us that the benefits of vaccination far outweigh the risks? There’s no debate about that.

According to the Church there were concerns raised by a number of people, including prominent church members who are experts in the field of ethics and public health, that the message promoted by the Australian Vaccination Network is not in line with the ethos and values of the Uniting Church in Australia.

No Uniting Church in the City venue is being made available to the AVN for tomorrow night’s meeting (update AEST 20:42, please see below; it has been cancelled with plans to reschedule in the next four weeks).

The AVN organised the seminar following the recent spate of adverse reactions to the seasonal flu vaccine in children under five years of age.

Australia wide, over 400 reactions have been reported, in five states, the majority of which occurred in Western Australia. Authorities are still investigating the cause of high fevers and febrile convulsions. Most children recovered, but one child in Queensland died 12 hrs after receiving the vaccine. The coroner found no evidence to implicate the vaccine.

The AVN seminar, “Flu Vaccines and Informed Choice” was described in an e-newsletter;

“This talk examines the risk of flu to children, the effectiveness of the vaccine and the additional risks to children’s health of adding another vaccine to the childhood schedule.”

Both media spokesperson and immediate past-president, Meryl Dorey and Murdoch University PhD candidate Judy Wilyman were scheduled to talk.

“To date, more than 300 serious reactions to the current seasonal flu shot have been reported in children under the age of 5 with one child known to have died within hours of being vaccinated. All the indications are that this figure grossly underestimates the actual number of reactions. In her talk, Meryl Dorey will discuss how vaccines are intended to work and why it is that they often don’t. She will talk about the known side effects of childhood and adult shots and reveal that according to the Australian government, as few as 1% of vaccine reactions ever get reported, leading to a belief that they are perfectly safe.”

This is not the first time the AVN has been refused access to a venue after having organised, booked and advertised a seminar. In 2009, they were forced to find another venue at short notice after a school in Mt Barker, South Australia declined their appearance, following notification of the nature of their material.

In a blog post entitled “AVN Under attack” Meryl Dorey described how those opposed to her ideas “…have tried to get venues where I am scheduled to present vaccination seminars to cancel and have harassed those who sponsor such events.”

Whilst publicly claiming to be the “pro-choice”, the AVN preaches a clear anti-vaccination message, designed to scare parents into shunning vaccinations for their children.

They were also recently refused paid advertising in The Child Group magazines, distributed free Australia wide and targeted specifically to parents, for similar reasons.

In South Australia, the AVN was able to secure a new venue at the last minute.

A recent tweet from the AVN (@nocompulsoryvac) published at 12:31 AEST, May 13th said; “Flying out to Perth, WA for our seminar tomorrow nite on flu vax. If you haven’t booked yet, extra chairs have been put in-call 1800 007 468 about 5 hours ago via HootSuite”.

At the time of writing, it is not known if Mrs Dorey is aware of the venue cancellation.

“UNITING CHURCH CANCELS AVN SEMINAR AT THE 11TH HOUR

At about 12:45 this afternoon, I was standing on line, waiting to board a plane that would take me to Perth. I had packed, arranged rides for my children, caught up on my office work for the next few days and was ready to just sit back, relax and enjoy the flight (while going over my powerpoint slides for the 20th time!)

As I was waiting my turn to give my ticket to the hostess, my mobile phone rang. I almost didn’t answer but seeing that it was a Western Australian number, I thought I’d better.

Little did I know…

On the other end of the phone was a Mr Andy Corkill who is the Mission Development Officer for the Uniting Church of Perth.

He was calling to inform me that the Church Council had received calls from the WA Dept of Health and from some of their own congregants including a senior academic from a university in Perth. All these people were urging the church to cancel our seminar which was taking place on Friday night.

Mr Corkill informed me that the Council had met the night before and decided that they would cancel the event and that there was really nothing he could do to change this because it was a decision made by the Council – not by him.

When I told him that we had over 100 people booked in to attend and that I was about to board a flight from QLD to Perth specifically for this event, he suggested that we find another venue. He was quite helpful and said they would be happy to post a sign at the Uniting Church to let people know the location of the new venue – hah!

I asked him where he thought I would be able to find a venue for over 100 people in just over 24 hours and he replied that he couldn’t help with that but I couldn’t have any Uniting Church venues.

So – off to the counter I go and ask them to pull my bags off the plane – down the $750 we paid to the Church for the venue and the almost $700 for the plane fares.

Don’t be downhearted!
A person could really be forgiven for feeling more than a little bit downhearted by these events. After all, there are children all across Australia who have died or been seriously injured by the flu vaccine in recent weeks. There is a little girl in PMH right now who was in a coma for some time and now faces a difficult and uncertain future because of this shot. And yet, the Department of Health and certain academics have decided that Australian parents need to be treated like mushrooms and kept away from any information that might call into doubt the safety of shots.

Unfortunately for them however, this action is going to backfire and backfire badly. This backlash is already starting!

The media in WA is now asking the following questions:

1- Who at the department of health chose to put pressure on the Church to force them to cancel our seminar? Why would a small event, attended by only 100 people, be of concern to the government?
2- Who was the senior academic who used his status as a member of the Uniting Church congregation and a supposed expert on this issue to state that the AVN should not be allowed to speak at a Church venue?
3- By trying to suppress this information, is the government trying to pretend that these reactions never took place? Are they stepping on our right to freedom of communication – a right that has been upheld by the High Court of Australia?

In the meantime, we contacted everyone who was booked into the seminar tomorrow to let them know it’s been cancelled. Several of these people have excellent contacts with larger and better venues in Perth and we are hoping to reschedule this talk for sometime within the next 4 weeks.

Of course, we will let you know as soon as we have rescheduled.

The Child group of magazines, covering Sydney, Melbourne, Brisbane, Adelaide, Canberra and Perth are free monthly publications distributed via childcare centres and baby shops and are highly targeted to Australian parents.

The website of Sydney’s Child describes the publication as, “..well established in the marketplace and highly respected by readers.”

“With six publications reaching across Australia, the Child group of magazines offer advertisers the ability to advertise nationally, or selectively depending on their needs. The tailored content within each magazine ensures that the publications always remain locally relevant to readers.”

All of which combines to make this the perfect platform for the AVN to scare parents into not vaccinating with their misinformation about vaccines causing autism, SIDS, shaken baby syndrome etc.

I understand that the AVN applied to purchase a 1/3 page ad in Sydney’s Child, Melbourne’s Child and Brisbane’s Child at a total estimated cost of $8000.

But in a highly principled and responsible move, it appears that the magazine declined the AVN the opportunity to do so, thus forfeiting a large amount of advertising money. This is a honorable move on their part, especially since being a free publication, they rely heavily on advertising revenue.

At question here is how the AVN came to have a spare $8000, after their recent donation drive initiated apparently to keep them from going under. Meryl apparently needed the cash to cover debts, so just a few weeks later she has enough in the coffers to blow eight grand on advertising?

I also wonder if her donors would be happy to see their money being diverted from keeping the AVN running to this new venture. That is, if indeed it is their money.

In August 2009, she was asking for donations to run a Generation Rescue ad, for which they would cover half the costs. An ad which never ran mind you, because we pipped her at the post. So it is possible that they have come to the party here.

In any case, I would have loved to have been a fly on the wall when Meryl was told that The Child group did not want her anti-vaccine money. If she was not already convinced there is a conspiracy to see her silenced, then she ought to be well and truly by now. Paranoid much? Well maybe you should be Meryl!

I would like to clarify that neither Australian Skeptics, Stop the AVN or myself had anything to do with this decision. I’m sure Meryl will blame us, and I certainly wish I had the influence to persuade publishers and journalists to never publish her nonsense again, but I don’t.

(Or do I? *look over there, it’s a reptilian overlord*)

Congratulations to The Child group for adhering to their editorial policy and extending this to advertising:

Editorial Integrity – Our editorial integrity ensures that advertisements are always viewed within the context of a highly regarded, quality publication. That our magazines are seen in such a favourable light contributes positively to how an advertiser’s message is received by our readers.

The Child Group had done a great service to public health by limiting the exposure of the AVN’s misinformation. And by doing so, they may have saved a baby’s life.

Last week, Meryl Dorey, President of the AVN announced the group would close its doors “on or near February 28th” citing monetary issues as the primary reason. This week, after several emails pleading with her members to step up and donate, or at least pledge to donate, she sent out an e-newsletter where she outlined what has been a tough year for her and the AVN.

In it she explains that;

“Approximately 12 months ago, an unremitting campaign of harassment began with a complaint filed by an anonymous complainant against the AVN with the Office of Liquor, Gaming and Racing (OLGR)….This whole situation came to a head about 7 months ago when a complaint was filed against both the AVN and myself with the HCCC. ….there have been an unending string of complaints filed against both myself and the AVN every time I’m on either the radio, TV or in newspapers. Without fail, the media will receive complaints stating that they should not be interviewing someone like myself who is not only anti-vaccine (in their words), but under investigation to boot!”

and;

“The people who are behind these attacks are, in my own personal opinion, totally without morals and ethics.”

The post you see at the top of this blog was the hard-copy version of the article, which also appeared in the online edition of the Daily Telegraph under the headline; “Anti-vaccination group to collapse” (which I like much better as you might have guessed).

Naturally Meryl was very disappointed in this article, telling her email group that;

“I knew I could count on Kate Sikora and the Daily Telegraph to get it all wrong – even when the information was provided to them in writing. One has to wonder how much pharmaceutical advertising the Daily Telegraph takes in every day and whether that would have any influence on the anti-choice, anti-science stance taken by papers such as the Telegraph?”

“The people on Australia are done a great disservice by this article and by the Telegraph’s continual refusal to allow science-based data on the dangers and ineffectiveness of vaccines to be published.” (1)

Funny that, I thought it was quite accurate. What was interesting was that according to the article:

“Contacted twice for comment yesterday, Ms Dorey referred The Daily Telegraph to her email.”

So she opted to not even speak to the journalist.

The comments also make for some interesting reading. I’ll bet Meryl would have preferred the one below didn’t get approved, especially since she is desperately trying to shake off the conspiracy theory tag which has recently stuck to her.

Perhaps Meryl has lost her trust in the media. Maybe because they have ceased taking her information on face value and are beginning to realise she is not someone they should be consulting on issues of vaccine effectiveness and safety. Maybe Meryl’s time in the spotlight is drawing to a close.

Still, with the results of two complaints with the HCCC and the OLGR auditing the AVN this week, there are likely much more serious things for her to deal with.

In a e-newsletter sent to subscribers, Meryl Dorey president of the AVN announced:

AVN to close it’s doors at the end of the month

The contents explained that after 17 years, Dorey was;

“…in the next 3-4 weeks…tendering my resignation as President of this great organisation and moving on to the next stage of my own personal development as mother, wife, activist and researcher.”

Which seems pretty clear cut, until further in the email she wrote:

“Without a large injection of capital behind me, I simply cannot continue.”

She used the word injection! Ms Dorey you do amuse! (sorry, couldn’t let that one go…)

She explained that closure at the end of the month could be avoided, but only if:

“..a benefactor or series of benefactors come forward to establish a fund that would guarantee the AVN’s existence for at least the next 2-3 years.”

This is not the first time Dorey has asked for money from her members – a few months ago she was asking people to put aside a percentage of their government paid family allowance to donate to the AVN. Then several days ago she asked for “$100 from each and every member” (AVN Message #42021).

But this comes as no surprise to us, we know she has been in financial difficulty of late. According to documents obtained by a colleague via the the Office of Liquor Gaming and Racing (OLGR) (this information is publicly available if a business is registered as a charity), the AVN lost AUD58,000 in the period January through December 2008.

The day following this email, Ms Dorey sent another email clarifying that the AVN would only close if she did not receive the required funds and she was sorry if she had worried her followers.

This clarification became somewhat clouded today however, when she sent another e-newsletter with the masthead exclaiming Living Wisdom/ AVN Closing down sale! (AVN message #42055).

So is she or isn’t she?

Until yesterday I had been wondering why she had not pleaded to the big guns for help, the likes of Generation Rescue and Age of Autism. That was until today when a blog appeared on the Age of Autism website, wherein between asking for an “injection of funds” again (*chortle*). She says the following about the “anti-choice movement”:

“I have had death threats from those who are too cowardly to confront me on the facts of my argument*.

I have had complaints filed against me… I have been called the Baby Killer of Bangalow…and told that I am personally responsible for the current record-high level of whooping cough despite the fact that our vaccination level is currently also at a record high.”

Personally I’m not surprised Ms Dorey wants out, and I suspect it is not solely to do with money. It has not been a good year for the AVN.

There are currently two complaints filed against her with the NSW Health Care Complaints Commission (HCCC), accusing her of spreading false information about the safety and efficacy of vaccines. We expect the findings to be handed down in the next few weeks. There are also two with the OLGR, the charity watchdog, one alleging she operated without a charity license for 2 years, whilst still collecting donations.

She has also received considerable mainstream criticism for her campaign of scaremongering and misinformation regarding the safety and efficacy of vaccines. Despite the General Medical Council finding Wakefield “callous”, “unethical” and “dishonest”, a complete retraction of the Wakefield et al paper on February 2nd, and a large body of scientific evidence discrediting his work, the anti-vaxers appear to have not changed their stance that vaccines contain toxic levels of elemental mercury, vaccines cause autism, shaken baby syndrome, SIDS and brain damage.

In August 2009, Dorey and the AVN were the target of a national newspaper advertising campaign, financed by entrepreneur Dick Smith warning parents of Australia not to listen to the false claims of the AVN. In publicity surrounding the publication, Smith criticised the organisation for portraying a public face of “pro-choice” when privately being unequivocally anti-vaccination. In a statement Smith said; “They should put on every bit of their material that they are anti-vaccination in great big words”.

Dorey has been heavily criticised for her misuse of scientific evidence, in particular her habit of “cherry picking” data to suit her agenda whilst publicly insisting she only cites peer reviewed studies from medical journals.

Dorey also outed herself as an “HIV denier” meaning she does not believe that HIV is the cause of AIDS. HIV deniers are a dangerous group of individuals, whose influence on South African President, Thabo Mbeki historically contributed to the unnecessary deaths of over 300,000 Africans as a result of delayed roll-out of anti-retroviral drugs.

Dorey also appeared to subscribe to conspiracy theories despite telling her email group;

“We are already seen as rapid idiotic fringe dwellers by so many in the mainstream, it does our argument no good at all to bring in conspiracy theories which though we may prescribe to them are unprovable”.

Yet, she later published a link to a conspiracy blog describing H1N1 (swine flu) as being manufactured by a group of drug cartels for the express purpose of extinguishing a large percentage of the world via compulsory vaccination, aerosol exposure via chem-trails and the implantation of mind control chips. The original story was attributed to (but not credited by Dorey) the world famous conspiracy theorist David Icke. You can see more here.

To top it off, the AVN was awarded the 2009 Australian Skeptics Bent Spoon awarded annually for the perpetrator of the most preposterous piece of paranormal or pseudo-scientific piffle and chosen from a list of public nominations.

Not to mention she has taken a battering in the press for spreading false statistics and scaremongering, and been forced to change seminar venues when organisers discovered the true nature of her ‘information’.

I think this might be the beginning of the end for the embattled AVN. And I for one won’t miss ‘em. At all.
